Unless there is a special written agreement, any order automatically entails the customer’s acceptance of our general conditions of sale, defined below.
Orders
Any order is considered final only after confirmation by our services. The delivery date will be confirmed after payment of the stipulated deposit. The prices considered always refer to our tariffs which may change without notice. For orders validated following the preparation of an estimate, the date of validation of the estimate must be considered.
Delivery times of our swimming pool covers
The delivery times are given as an indication only and are ex works. In any case, we cannot be held responsible for the impossibility of delivery or for any delays in delivery.
Pool cover prices
Our prices are exclusive of taxes (H.T.) and ex works.
Transport of a shutter
The delivered goods travel at the customer’s risk. It is the responsibility of the recipient to confirm, upon receipt, the conformity of the materials received (in quantity and quality).
Retour de matériel
No return of material will be accepted without our prior agreement. The return of the material will be charged to the customer.
Conditions de règlement
All merchandise must be paid for: 30% deposit at the time of order by check and balance by check upon delivery.
A cash payment can be required for a first order.
In case of non-payment, interests of 1,5% per month will be debited.
In case of default of a debtor, the file will be immediately transmitted to the legal services which will give him continuation according to our internal policy. All material remains the property of our company until full payment (Law nº 80.335 of 12/05/80)
General Warranties
The general warranty for our equipment is 2 years after delivery. The guarantee considers the material delivered by our company and ensures the repair, in our care and in our workshops, of manufacturing defects or defective materials. This guarantee does not consider the costs of installation or transport. Our liability is limited to the replacement of defective parts. The guarantee ceases after any modification made by the customer. All our products are manufactured in accordance with the plans in our technical manuals. Any guarantee is suspended in case of delay of payment by the customer. We are not responsible for any failure in operation, which can be caused by many varied reasons.
SAFESWIM® roofing systems warranties
The waterproofness and buoyancy of the boards is guaranteed for 3 years. The warranty does not cover the discoloration of the boards or the appearance of stains do not present at the time of their delivery. Damage caused by unforeseen phenomena, natural phenomena such as lightning, storm flooding, etc., is also excluded as well as use not in accordance with our instructions. The winding mechanism is guaranteed for 2 years. The guarantee does not cover degradation or corrosion caused using saltwater chlorinators or incorrectly adjusted electro-physical devices.
Responsibility
Soprefa France, S.A. is not responsible for any damage directly or indirectly caused by failures of the systems in question, to persons, animals or objects, especially because of failure to observe all the instructions given in the installation manual, in particular the recommendations concerning the installation, use and maintenance of the system.
Juridiction
Any dispute or litigation will be under the sole district of the court of Nantes.
Cause de déchéance du terme
The default of a debtor on a due date not granted or not agreed upon by our company entails the immediate playability of all sums due on the date, even those not due.
Évolution du produit
We reserve the right to make changes to the product that are deemed important for its improvement in relation to the needs of the market, without any prior notice.
Validation de la garantie
All warranties (materials, operation, safety, etc.) are validated only after Soprefa France S.A. has received the Warranty Validation Form, which is filled in and signed by the customer. Our warranty validation form can be downloaded from our website.
